AGREEMENT

on the usage of the public procurement web portal by the User


1. General Provisions

1.1. The public procurement portal "_________" (hereinafter referred to as the Portal) is a state information system, providing a single point of access to electronic services of electronic public procurement.

1.2. The Owner of the Portal (hereinafter referred to as the "Owner") is the Agency on State Procurement of Goods, Work and Services under the Government of the Republic of Tajikistan, which regulates the public procurement system.

1.3. User is any natural person, who registered on the Portal and uses it.

1.4. The Administrator of the Portal (hereinafter referred to as the Administrator) is the Agency of Public Procurement of Goods, Work and Services under the Government of the Republic of Tajikistan, authorized to implement a unified technical policy in the area of electronic public procurement, placement and exchange of information on the Portal.

1.5. The terms and definitions used in this Agreement shall be interpreted according to the current legislation of the Republic of Tajikistan.


2. Subject of the Agreement

2.1. This User Agreement (hereinafter referred to as the Agreement) is concluded between the Owner, the User and the Administrator to regulate the relationship of usage and provision of electronic public services on the Portal.

2.2. This Agreement can be changed by the Owner and the Administrator by agreement with the Owner unilaterally without the User's consent. Whereas, the Owner and / or the Administrator shall notify the User of the changes and / or amendments made to the Agreement by posting to the appropriate notice on the Portal page.

3. Rights and obligations of the User

3.1. The user has the right to:

3.1.1. receive consulting and practical assistance from the Administrator in the use of the Portal;

3.1.2. receive methodical recommendations from the Owner in the area of public procurement.

3.2. The User is obliged to:

3.2.1. provide the Owner and Administrator with accurate and complete information, if necessary on the items proposed in the registration form;

3.2.2. not impersonate another natural person;

3.2.3. keep your password secret;

3.2.4. do not violate, intentionally or accidentally, any applicable state or international laws;

3.2.5. do not post on the Portal:

1) information that the User does not have the right to make public by law or according to any contractual relationship;

2) information that violates current legislation, honor and dignity, rights and legally protected interests of third parties;

3) information that violates copyrights and / or related property rights;

4) information of insulting  content, and be in further propagandizing discrimination of people on any grounds, violence, hatred;

5) information and / or links to materials containing viruses or other malicious software.
6) any other information that does not meet the stated goals of using the public procurement web portal


4. The Rights and Obligations of the Owner

4.1. The Owner has the right:

4.1.1.to request and receive the necessary information and materials from the User in the manner determined by the legislation of the Republic of Tajikistan on public procurement;

4.1.2. verify the reliability of the reporting data, materials and information provided by the User on the Portal.

           4.2. The Owner is obliged to:

4.2.1. determine the procedure for providing electronic services to the subjects of the public procurement system and other interested persons;

4.2.2. to provide methodological guidance in the area of public procurement.

           
5. Rights and Obligations of the Administrator

5.1. The Administrator has the right:

5.1.1. in the event of violation by the User of the terms of this Agreement, refuse to register the User, delete or block the User account.

5.2. The Administrator is obliged to:

5.2.1. ensure the functioning and technical support of the Portal;

5.2.2. To provide consulting and practical assistance to the User on using the Portal


6. Entry of the Agreement into force 

6.1. The Agreement comes into force after registration of the User on the Portal.

6.2. The registration is performed by filling out the User registration form, expressing the User's consent to all terms of this Agreement, and sending the registration form data to the Portal.


7. Responsibility

7.1. Upon the placing of any information and materials on the Portal, the User bears personal responsibility for the content of materials, data, placed by him, the legality of their placement and usage according to the legislation of the Republic of Tajikistan.

7.2. The User is personally responsible for the safe storage of his password, and be in further for the consequences that can occur when he compromises.

7.3. The User is personally responsible for the timely posting on the Portal of materials, information, information, reporting, subject to mandatory placement on the Portal.

7.4. The Owner, Administrator are not responsible for the content of information, materials posted by the User on the Portal, their compliance with the requirements of the legislation of the Republic of Tajikistan, for the User's misconduct on the usage of information and materials posted on the Portal, for violation of copyright by the User and any other rights of third parties.

7.5. The Administrator is not responsible for technical temporary failures and interruptions to the Portal's operation that have occurred due to reasons beyond the control of the Administrator or the Owner, or in the event of scheduled or unplanned maintenance of the Portal.

7.6. The Owner and the Administrator are not liable for temporary failures and interruptions in the operation of communication lines, other similar failures, as well as for the malfunction of the computer from which the user accesses the Internet.

7.7. The Owner and the Administrator shall not be liable to the User for the actions of other Users and any other participants of the Portal.

7.8. The Owner and the Administrator are not liable for any direct, indirect damage, including lost profits, loss of use, loss of data or any other non-material loss, damage to reputation or other damage resulting from:

7.8.1. usage or inability to use the Portal;

7.8.2. changes in the terms of the Agreement;

7.8.3. unauthorized access to the User's data or changes in the data transmitted by the User or stored on the server;

7.8.4. any other case, related to the services, provided on the Portal.


8. Other conditions

8.1. The User does not object to the obtaining and publication by the Owner of additional information about himself, contained in government and / or non-governmental information systems (databases) and / or making bank, commercial, official and / or tax secrets.

8.2. All claims, requests, questions, any other correspondence concerning the work of the Portal should be sent to the e-mail address, specified on the main page of the Portal.

8.3. The relations between the User, the Owner and the Administrator within the framework of this Agreement are governed by the legislation of the Republic of Tajikistan.

8.4. Lack of actions on the part of the Owner and / or the Administrator in the case of violation by the User or other users of the provisions of the Agreement does not deprive them of the right to take appropriate actions in defense of their interests later.

8.5. In case of receipt of claims from third parties related to the placement and / or usage of materials, the User shall independently and at his own expense settle these claims.
